Disney Beats Infringement Suit Over Surfing Co.'s Mark

Law360, New York (May 12, 2011, 2:16 PM EDT) -- A California federal judge ruled Wednesday that a Walt Disney Co. unit did not infringe Stewart Surfboards Inc.'s trademark by featuring one of its surfboards on a book cover, saying that the use was protected by the First Amendment.

U.S. District Judge Gary A. Feess dismissed with prejudice the surfing company's lawsuit claiming Disney Book Group LLC impermissibly used the Stewart Surfboards trademark in the depiction of a surfboard that appears on the back cover of the book “Hannah Montana: Rock the Waves.”
