Coke Settles Bottle Design Claims Against Aldi

Law360, New York (May 12, 2011, 5:07 PM EDT) -- The Coca-Cola Co. on Thursday settled unfair competition, trade dress and patent infringement claims in a Georgia suit over carafe-style plastic juice bottles sold by supermarket chain Aldi Inc.

U.S. District Judge Charles A. Pannell signed off on an order approving stipulation of dismissal between the parties, ending Aldi's involvement in the case.

Coca-Cola filed the suit in September against Aldi and Johanna Foods Inc., claiming that the defendants infringed two design patents pertaining to its Simply juice brand by making, using or selling Johanna-supplied bottles...
