2nd Circ. Revives Penguin Online Book Piracy Suit

Law360, New York (May 12, 2011, 4:23 PM EDT) -- The Second Circuit on Thursday revived a copyright suit brought by Penguin Group USA Inc. against online library American Buddha after a New York state appeals court determined the publisher could pursue the out-of-state website.

The New York Court of Appeals, the state's highest court, had concluded in March that in cases in which a copyrighted printed literary work is posted on the Internet, the site of the injury to the copyright holder is where the copyright holder is located — in Penguin's case, New York....
