Flynt Brother Can't Cash In On Hustler

Law360, New York (May 12, 2011, 7:41 PM EDT) -- An Ohio federal judge ruled Thursday that Jimmy Flynt can’t claim a partnership interest in his older brother Larry Flynt’s Hustler adult entertainment enterprise, saying Jimmy Flynt failed to prove in an infringement dispute that a partnership ever existed.

The ruling throws out Jimmy Flynt’s allegations of unjust enrichment, unfair competition and other counterclaims in the suit, which Larry Flynt lodged in 2009, accusing Jimmy Flynt of infringing the Hustler trademark through a retail store he owns in Cincinnati.
