Class Decertified In AT&T Asst. Managers' OT Action

Law360, New York (May 13, 2011, 12:53 PM EDT) -- A New York federal judge on Thursday decertified a class of more than 4,000 AT&T Mobility LLC assistant store managers and retail sales consultants who claim they were denied proper overtime compensation, deciding post-discovery that they are not similarly situated.

Assistant manager Gamze Zivali sued AT&T Mobility in November 2008 seeking an award of unpaid wages, maintenance costs and overtime compensation under the Fair Labor Standards Act and New York state labor law.
