Hollywood Looks To High Court On Idea Submission

Law360, New York (September 6, 2011, 2:58 PM EDT) -- Dismayed by a Ninth Circuit ruling that makes it difficult to dismiss suits by writers who claim their ideas were stolen by movie studios or TV networks, the entertainment industry is now looking to the U.S. Supreme Court to weigh in on the issue.

In a May en banc ruling, the Ninth Circuit concluded that so-called idea submission suits can be brought as state law breach of implied contract claims, a decision that reversed both a lower court and a panel decision that contract claims in such cases are preempted by the Copyright Act.
