Sale Negates Duke Ellington Royalties Contract: Atty

Law360, New York (May 17, 2011, 7:48 PM EDT) -- Viacom Inc.'s 2007 sale of a music publishing affiliate to a Sony Corp. joint venture effectively canceled a royalties agreement with the heirs of jazz musician Duke Ellington, an attorney told a New York appeals court Tuesday.

"The linchpin of this case is a debated factual position" — whether Famous Music Corp., which Viacom sold, still exists, said Alexander Zubatov of Scarola Malone & Zubatov LLP, which represents Ellington's grandson, Paul M. Ellington.
