Coke USPTO Opposition On Hold In 'Zero' IP Fight

Law360, New York (May 18, 2011, 4:58 PM EDT) -- Apple Rush Co. said Tuesday that the U.S. Patent and Trademark Office has suspended The Coca-Cola Co.'s opposition to the organic juice company's efforts to register the mark “Naturally Zero” pending the resolution of a federal lawsuit.

The USPTO's Trademark Trial and Appeal Board on May 12 granted Apple Rush CEO Robert Corr's motion to suspend Coke's opposition proceeding until the final outcome is reached in an Illinois lawsuit accusing Coke of unlawfully usurping its “Zero” marks from a Canadian spring water company.
