Solvay Still Faces Action Over Pension Changes

Law360, New York (May 25, 2011, 2:21 PM EDT) -- Solvay Chemicals Inc. lost a bid Tuesday to dispose of the sole remaining claim in an Employee Retirement Income Security Act class action over changes to its pension plan, with a Wyoming federal judge denying Solvay's motion for summary judgment.

U.S. District Judge Alan B. Johnson ruled there are issues of material fact as to whether Solvay's notice concerning a change to its early retirement benefits was an "egregious failure" to comply with ERISA.
