Medicaid Can Seek Money From Insurers: Mont. Court

Law360, New York (May 26, 2011, 7:19 PM EDT) -- The Supreme Court of Montana ruled Tuesday that the state's health department can seek reimbursement from Medicaid recipients' insurers, reversing a decision in a class action brought by Medicaid recipients fighting the state's liens on outside sources of income.

Terry Blanton filed the suit in February 2006 on behalf of Medicaid recipients who were subject to a Medicaid lien, claiming the state was collecting more money than it was entitled to from plaintiffs' recoveries from other sources, such as legal settlements or insurance. The state's liens...
