Judge Won't Jail Former Gemstar Chairman

Law360, New York (May 15, 2007, 12:00 AM EDT) -- A federal judge has denied the U.S. Securities and Exchange Commission's attempt to put the former chairman of Gemstar-TV Guide International Inc. behind bars until he pays millions to the government.

Last year, Judge Mariana Pfaelzer of the U.S. District Court for the Central District of California ordered Henry Yuen to pay $22 million—the steepest penalty ever sought by the SEC in an accounting fraud case—to settle civil charges that he schemed to inflate his company’s revenues.
