Hydroxycut MDL Claims Fall Short, Judge Says

Law360, New York (June 1, 2011, 2:22 PM EDT) -- A California federal judge on Tuesday partially granted Iovate Health Sciences USA Inc.’s bid to drop claims in the multidistrict litigation against the company over alleged health problems caused by dietary supplement Hydroxycut, but allowed the plaintiffs to amend their complaint.

U.S. District Judge Barry Moskowitz ruled that the plaintiffs’ first amended class action complaint failed to properly allege multiple consumer protection, unjust enrichment and breach of warranty claims against Iovate, as well as GNC Corp., Walgreen Co. and numerous other retailers.
