Tribe Can't Force Mining Co. To Pay EPA Fines: 9th Circ.

Law360, New York (June 1, 2011, 7:09 PM EDT) -- The Ninth Circuit on Wednesday dismissed an Indian tribal group’s attempt to force Teck Cominco Metals Ltd. to pay about $24 million in penalties for not complying with a U.S. Environmental Protection agency cleanup order.

The appeals court affirmed a Washington district court’s ruling that the Confederated Tribes of the Colville Reservation does not have the authority to force the Canadian mining company to pay fines to the EPA for not cleaning up contamination caused by one of Teck Cominco’s smelters that befouled the Columbia River....
