US Can’t Shoot Down $17M Munitions Order Dispute

Law360, New York (June 6, 2011, 4:58 PM EDT) -- An administrative judicial panel on Monday unveiled an opinion denying the Pentagon’s request to throw out a case brought by General Dynamics Ordnance and Tactical Systems Inc. seeking a $17 million price adjustment on a series of ammunition orders.

In the opinion, issued May 26, three judges on the Armed Services Board of Contract Appeals ruled the case should continue because it remained unclear whether General Dynamics and the U.S. Department of the Army were engaged in a basic ordering agreement or a requirements contract....
