Hartford Wants Off Hook For Credit Card Info Actions

Law360, New York (June 9, 2011, 2:01 PM EDT) -- Hartford Fire Insurance Co. sued Children's Place Retail Stores Inc. in New Jersey last week, arguing that it shouldn't have to cover the clothing retailer for putative class litigation alleging improper collection of customers' personal information during credit card transactions.

In the June 3 complaint, the insurer argues that it has no duty to defend Children's Place in the proposed consumer class actions in California because there is no alleged offense constituting personal and advertising injury as defined under the commercial general liability policies at issue,...
