Low Bidder Should Get NY Town Trash Contract: Court

Law360, New York (June 9, 2011, 7:12 PM EDT) -- New York’s highest court ruled Thursday that the town board of Southeast erred in awarding a $1.5 million per year waste disposal contract to a company based on the belief that it was more responsible than an equally qualified lower bidder.

The Court of Appeals of the State of New York said the board wrongfully selected Suburban Carting Co. over AAA Carting and Rubbish Removal Inc., which submitted a $1.2 million bid, using subjective criteria not outlined in the town’s bid proposal.
