Bed Bath & Beyond Suit Dismissed

Law360, New York (May 21, 2007, 12:00 AM EDT) -- A New York State Supreme Court judge has dismissed a complaint filed against retailer Bed Bath & Beyond over alleged options backdating, ruling that the plaintiffs did not adequately plead demand futility.

On Friday, Judge Charles Ramos granted Bed Bath & Beyond’s motion to dismiss the derivative suit, finding that the plaintiffs had not shown that they had taken remedial actions before filing the civil complaint.
