Micron, Hynix Must Relitigate Rambus Docs Dispute

Law360, New York (June 16, 2011, 8:38 PM EDT) -- Micron Technology Inc. and Hynix Semiconductor Inc. on Thursday lost their bid to avoid relitigating a dispute over whether they can use privileged documents as evidence in a California state antitrust case brought by rival Rambus Inc.

Judge James McBride rejected the companies’ request to apply to the antitrust case a 2006 federal court order piercing Rambus’ attorney-client privilege for destroying documents in a related patent suit, meaning the companies will have to relitigate the issue or seek permission to introduce materials on a case-by-case basis....
