Ford Hit With Class Action Over Cracked Tailgates

Law360, New York (June 17, 2011, 5:27 PM EDT) -- A proposed nationwide class of customers sued Ford Motor Co. on Wednesday in California, alleging the automaker refused to fix cracks in their sport utility vehicles' tailgates under a warranty even though it knew a defect had caused the cracks.

Ford knew in early 2002 that the cracks were caused by moisture that built up behind the tailgates' lower window panel due to a design or manufacturing flaw, the complaint says. But the company continued to sell the cars through model year 2005 and purposefully kept...
