US Says Contractor Ducked Claims Process In $4M Suit

Law360, New York (June 17, 2011, 4:39 PM EDT) -- The federal government asked the U.S. Court of Federal Claims on Friday to throw out a defense contractor’s suit to recover more than $4 million on an Iraq War contract, saying the company failed to follow the claims process.

Government lawyers told the COFC that Agility Defense & Government Services Inc. did not bring before a contracting officer its claim for a $4.36 million adjustment to the contract prior to filing suit, barring the court from exercising jurisdiction over the case.
