Claims Cut From Ex-Eisai Worker's Whistleblower Suit

Law360, New York (June 21, 2011, 7:49 PM EDT) -- A Florida federal judge on Tuesday cut four claims from a former employee's 34-count whistleblower suit alleging Eisai Inc. promoted unapproved uses of lymphoma drugs and other medications, stripping out retaliation, kickback and some false claims allegations.

U.S. District Judge Ursula Ungaro ruled that a release relator Michael Keeler signed with Eisai barred his claim for retaliatory termination and that three other counts in the complaint failed to state a claim for relief.
