Novo Hit With Overtime, Break Action From Sales Rep

Law360, New York (June 24, 2011, 1:29 PM EDT) -- Novo Nordisk Inc. on Wednesday removed to federal court a putative class action originally lodged in California state court that accuses the company of misclassifying sales representatives as exempt from overtime pay and wrongly denying them meal and rest breaks.

The New Jersey-based diabetes-drug maker said that removal was justified under the Class Action Fairness Act because diversity of citizenship exists and the suit seeks more than $5 million.
