Agility Didn't Duck Claims Process In $4M Suit: Judge

Law360, New York (June 24, 2011, 7:33 PM EDT) -- A federal judge on Friday rejected the U.S. government's request that he reconsider his remand of a defense contractor’s bid to recover $4.36 million from an equipment maintenance contract, saying he had jurisdiction to send the case to the contracting officer.

Judge Thomas C. Wheeler of the U.S. Court of Federal Claims shot down the government's motion, filed Thursday, which argued his decision to remand the case was incorrect because Agility Defense & Government Services Inc. had allegedly never submitted a claim to the contracting officer....
