5th Circ. Won't Revive FEMA Trailer Bellwether Fight

Law360, New York (June 27, 2011, 8:10 PM EDT) -- The Fifth Circuit on Friday affirmed the dismissal of a New Orleans woman's suit consolidated with multidistrict litigation that alleged trailers issued by the government after Hurricane Katrina exposed residents to high levels of formaldehyde.

The appeals court affirmed that the Federal Tort Claims Act's two-year statute of limitations barred Alana Alexander's suit, which she filed on behalf of her son, whose asthma was allegedly worsened by formaldehyde in their trailer.
