Apple 'Geniuses' Denied Class Cert. In Rest Break Case

Law360, New York (June 28, 2011, 1:09 PM EDT) -- A California state court judge last week refused to certify a class of "geniuses," Apple Inc.'s hourly paid in-store technical support personnel, in a suit alleging the employees were denied required rest breaks.

Judge James McBride signed an order June 21 rejecting a motion from plaintiff Steve Camuti, who court papers say worked as a genius and a genius captain, to certify a class of Apple geniuses employed by the company in California since Sept. 15, 2005.
