5th Circ. Affirms Bayer Win In Crawfish Buyers' Suit

Law360, New York (June 28, 2011, 7:42 PM EDT) -- The Fifth Circuit ruled Tuesday that a Louisiana federal court justifiably tossed a putative class action filed by crawfish buyers against Bayer CropScience LP and an insurer over a Bayer pesticide that allegedly devastated the state's crawfish crops.

The Louisiana trial court had granted summary judgment bids from Bayer and Allianz Global Risks U.S. Insurance Co. in May 2010, ruling that plaintiffs Opelousas Crawfish House and Tess Wiltz could not bring forth tort claims because they had not suffered damage to their own persons or property....
