Ally Financial Whittles Mortgage Underwriter FLSA Claims

Law360, New York (June 30, 2011, 6:21 PM EDT) -- Ally Financial Inc. on Wednesday resolved overtime claims in Washington state from a former mortgage underwriter, though it still faces a separate class action similarly alleging that the bank misclassified its mortgage staff.

Plaintiff Darlene Darling, a former employee at Ally’s mortgage business Residential Capital LLC, and the bank filed a joint motion of dismissal after resolving claims that mortgage underwriters were misclassified as exempt for overtime pay under federal and state law.
