Appeals Panel Remands MTBE Cases To State Courts

Law360 (May 25, 2007, 12:00 AM EDT) -- An appeals court has revived efforts by California and New Hampshire to sue oil companies for alleged methyl tertiary butyl ether contamination of water supplies in their respective states.

The U.S. Court of Appeals for the Second Circuit ruled in a unanimous decision Thursday that there was no federal jurisdiction to hear California’s and New Hampshire’s cases and that they needed to be returned to state courts, where they were initially filed.
