Abbott Escapes Class Action Over Infested Similac

Law360, New York (July 8, 2011, 7:14 PM EDT) -- Abbott Laboratories Inc. on Friday squashed a proposed class action brought in Illinois federal court over insect parts found in the company's Similac baby formula.

Indiana resident Chalonda Jasper launched the suit after Abbott recalled more than five million containers of Similac over concerns they could be contaminated with beetles or beetle larvae.

The U.S. Food and Drug Administration had warned that infants could suffer gastrointestinal discomfort and temporarily refuse to eat, but U.S. District Judge Virginia Kendall pointed out that Jasper never claimed her son...
