2nd Circ. Tosses Dow Jones Age Bias Suit

Law360, New York (July 11, 2011, 4:15 PM EDT) -- The Second Circuit affirmed Monday the dismissal of an ex-Smart Money photo editor's age bias suit against Dow Jones & Co. Inc., ruling that a separation agreement the then-62-year-old had signed barring such actions was enforceable.

Ex-Smart Money photo editor Thomas Ridinger contended the agreement did not comply with the Older Workers Benefit Protection Act's requirement that waivers of age bias claims must be written "in a matter calculated to be understood" by an employee. However, the Second Circuit rejected that argument.
