E&Y Wins Stay Of Ex-Worker's NY Overtime Action

Law360, New York (July 11, 2011, 7:39 PM EDT) -- A New York state judge has stayed a proposed class action claiming Ernst & Young LLP illegally withheld overtime pay, ruling the lead plaintiff is contractually obligated to first bring his claims to an arbitrator, according to court documents filed Monday.

The stay order — dated July 1 and filed with the court Monday — puts the brakes on a suit brought by ex-Ernest & Young employee Brian Mansberger arguing the accounting giant violated New York labor law by misclassifying him and other uncertified public accountants...
