Quest Escapes FCA Suit Over Medicare Kickbacks

Law360, New York (July 13, 2011, 12:55 PM EDT) -- A New York federal judge on Tuesday dismissed a suit against Quest Diagnostics Inc. brought by a subsidiary’s ex-employees accusing the company of running a Medicare kickback scheme to increase its reimbursable test referrals, following the government’s decision not to intervene.

U.S. District Judge Robert P. Patterson Jr. ordered the court to enter final judgment in favor of defendants Quest and subsidiary Unilab Corp., based on his March 24 order disqualifying qui tam relator Fair Labor Practices Associates from the suit and the government’s July 5...
