Class Certified In JPMorgan ERISA Case

Law360 (May 31, 2007, 12:00 AM EDT) -- A judge has certified but significantly diminished a class of JPMorgan Chase & Co. employees in a suit claiming that the bank's cash-balance pension system is age discriminatory.

U.S. District Judge Harold Baer on Wednesday certified a class of employees who were participants and received notices about a 2002 JPMorgan pension plan. The employees claim the notice failed to inform them of an impending decrease in their retirement benefits under a new cash-balance plan that went into effect in December 1998.
