Same-Sex Couples Win Class In CalPERS Insurance Fight

Law360, New York (July 18, 2011, 4:48 PM EDT) -- A California federal judge on Friday certified a class of state employees in same-sex partnerships claiming that tax provisions of the California Public Employees' Retirement System that deny long-term care insurance to gay and lesbian spouses and domestic partners are unconstitutional.

U.S. District Judge Claudia Wilken certified a class of present and future CalPERS members in same-sex marriages or domestic partnerships and their partners who were denied CalPERS long-term care insurance that members in heterosexual marriages and their spouses enjoyed.
