Insurer Must Face Timber Co.'s Suit Over Wildfire

Law360, New York (July 19, 2011, 7:44 PM EDT) -- A California federal judge on Monday kept alive Sierra Pacific Industries' suit alleging American States Insurance Co. violated a duty to defend it against $1 billion in claims resulting from a massive wildfire.

Sierra Pacific is battling seven separate suits brought by the U.S. Department of Agriculture, the California Department of Forestry and Fire Protection, and private plaintiffs seeking damages caused by the Moonlight Fire, which burned 65,000 acres in California's Plumas and Lassen counties in September 2007.
