Pentagon Bars Contractors From Interrogations

Law360, New York (July 25, 2011, 4:43 PM EDT) -- The U.S. Department of Defense on Monday issued a final rule barring contractor personnel from interrogating detainees in the department's custody, rejecting calls by some to eliminate a provision that allows a waiver of the prohibition for a limited time.

The waiver allows the defense secretary to override the prohibition if national security interests are jeopardized. The DOD has said the secretary could unilaterally waive the rule for 60 days, with the option of an additional 30-day renewal, on the condition that he or she informs...
