CVS Pharmacists Denied Class Cert. In OT Action

Law360, New York (July 26, 2011, 12:48 PM EDT) -- A California federal judge on Monday refused to certify a class of over 4,000 pharmacists in a suit claiming CVS Pharmacy Inc. failed to pay proper overtime compensation and prevented pharmacists from taking meal and rest breaks.

The named plaintiffs sought to represent three subclasses of employees with job titles including pharmacy team leaders or pharmacists-in-charge, pharmacist interns or graduate pharmacist interns, and staff pharmacists at any of CVS' more than 800 California locations during the past four years.
