Contractor Denied Own Hurricane Cleanup Fraud Trial

Law360, New York (July 27, 2011, 6:56 PM EDT) -- A Texas federal judge on Wednesday refused to grant a separate trial to a contractor accused of funneling kickbacks to a connected Texas county judge for work on a $3.2 million federally funded hurricane cleanup project.

Defendant Mark Wayne Miksch argued he would look bad if tried alongside his co-defendants — a former judge and a county commissioner — but U.S. District Judge Ron Clark refused to split up the trial.

“Severance is not justified on the record before the court,” Judge Clark said.
