Gaspari Misled Customers About Novedex XT, Suit Says

Law360, New York (July 28, 2011, 9:12 PM EDT) -- Gaspari Nutrition Inc. on Wednesday removed to California federal court a proposed class action accusing the company of marketing its Novedex XT product as a dietary supplement when it actually contains a nondietary ingredient.

Plaintiff James Keller, a fitness and weight-training devotee, allegedly bought Novedex XT in August based on Gaspari's Internet advertising and product labels saying it was an all-natural dietary supplement. He did not believe it contained synthetic ingredients and would not have purchased it if he had known it did, he says....
