5th Circ. Affirms Biodiesel Exec's $3M Fraud Conviction

Law360, New York (July 28, 2011, 8:02 PM EDT) -- The Fifth Circuit on Thursday upheld a Mississippi biodiesel company head's conviction for defrauding a U.S. Department of Agriculture alternative fuel subsidy program of $3 million.

Defendant William Tacker II, president of Biodiesel of Mississippi Inc., claimed the judge who presided over his jury trial allowed a weak case against him to go forward and improperly let a cooperating witness testify against him.
