KB Home Ducks Sales Staffers' OT Class Action

Law360, New York (July 28, 2011, 9:25 PM EDT) -- A Texas federal judge on Thursday dismissed a class action accusing major homebuilder KB Home of failing to pay thousands of sales staff members overtime, finding the workers to be legally exempt.

U.S. District Judge Kenneth M. Hoyt ruled that sales staffs that worked in KB offices in newly developed subdivisions were legally “outside sales staff,” a group that has long been exempted under national overtime laws.
