Comcast, Qwest Clash Over Internet Speed Claims

Law360, New York (June 5, 2007, 12:00 AM EDT) -- Comcast has filed a trademark infringement lawsuit against Qwest Communications International Inc. saying Qwest's claim that its Internet service is faster that Comcast's is intentionally deceptive.

The three-claim complaint was filed Monday in Colorado district court by Comcast Cable Communication Management LLC, and invokes the Lanham Act, Colorado's Consumer Protection Act and the common law of Colorado and other states pertaining to unfair competition. The suit seeks treble damages and an injunction barring the defendant from asserting that it provides quicker Internet service.
