Judge Trims Boehringer Sales Reps' OT Class Action

Law360, Los Angeles (August 2, 2011, 10:21 PM EDT) -- An Illinois federal judge denied conditional certification for Boehringer Ingelheim Pharmaceuticals Inc. sales representatives and dismissed the Fair Labor Standards Act claims of the two named plaintiffs Tuesday, leaving alive only their individual state law claims.

U.S. District Judge Gary Feinerman agreed with Boehringer’s argument that plaintiff Annette Allen’s participation in an earlier Connecticut FLSA action barred her claims in the present suit, and said the company could enforce a class action waiver that plaintiff Catherine Copello signed in exchange for a $15,000 severance payment....
