NYPD Sergeants Not Exempt From OT Laws: 2nd Circ.

Law360, New York (August 8, 2011, 2:47 PM EDT) -- The Second Circuit on Friday told a lower court to enter judgment in favor of roughly 4,300 current and former New York City police sergeants in a putative collective action that claimed overtime violations, rejecting the city's argument that the officers were exempt from federal overtime pay requirements.

In a 30-page decision, a three-judge panel held that the sergeants did not qualify for the executive exemption from the Fair Labor Standards Act's overtime pay provisions because their primary duty was not management, reversing the lower court...
