Check Cashing Co. Faces Class Action Over Data Theft

Law360, New York (August 8, 2011, 7:46 PM EDT) -- An identity theft victim slapped a Southern California check cashing operation with a putative class action Friday, alleging it breached customer contracts and violated state law by negligently failing to protect personal information that was stolen as part of a computer robbery.

Named plaintiff Thomas Davis contends that Nix Check Cashing Community Outreach Foundation didn't maintain reasonable security procedures to prevent the disclosure of their customers' nonpublic information, leaving him and other members of the proposed class vulnerable.
