Attys In Lufkin Bias Suit May Get Higher Fees: 5th Circ.

Law360, New York (August 8, 2011, 7:27 PM EDT) -- The Fifth Circuit ruled Monday that outside counsel for the plaintiffs in a long-running racial discrimination class action against Lufkin Industries Inc. may be entitled to a higher fees award to reflect the higher rates in their home jurisdiction.

The class action, first brought in 1997, involves hundreds of black plaintiffs who allege they were adversely affected by the Texas-based energy equipment manufacturing company's practice of delegating assignment and promotion authority to its managers.
