11th Circ. Deems AT&T Class Action Waiver Valid

Law360, New York (August 11, 2011, 8:07 PM EDT) -- In the wake of the U.S. Supreme Court's ruling in AT&T Mobility LLC v. Concepcion, the Eleventh Circuit on Thursday affirmed that plaintiffs in a putative consumer protection class action against AT&T Mobility predecessor Cingular Wireless LLC must enter arbitration.

The plaintiffs claim the phone company violated the Florida Deceptive and Unfair Trade Practices Act by automatically enrolling them in a $2.99 per month roadside assistance plan that purports to provide customers with towing services and other car trouble assistance.
