9th Circ. Affirms Dismissal Of Health Care Law Suit

Law360, New York (August 12, 2011, 5:50 PM EDT) -- The Ninth Circuit on Friday upheld the dismissal of a suit challenging the individual mandate provision of the Patient Protection and Affordable Care Act, ruling a former California legislator and a nonprofit group had not alleged an actual injury.

A three-judge panel echoed a California federal judge's ruling that former California Assemblyman Steven Baldwin and the Pacific Justice Institute lacked standing to bring the suit.
