Software Co. Promotes Groupon Name Change In TM Fight

Law360, New York (August 16, 2011, 5:35 PM EDT) -- Groupion LLC asked a California federal judge Monday to rule that online discount provider Groupon Inc. was infringing its trademark and confusing consumers by offering a similar product, and should be barred from operating as "Groupon" or other, similar names.

In its motion seeking summary judgment and a preliminary injunction, Groupion claims it established a mark that covers its web-based customer relations management software prior to Groupon's software development.
