7th Circ. Nixes Class Cert. For Aqua Dots Consumers

Law360, New York (August 17, 2011, 5:49 PM EDT) -- In a proposed class action against the makers and distributors of the recalled Aqua Dots toys, the Seventh Circuit on Wednesday affirmed a lower court's decision not to certify a class of consumers whose children were not harmed by the toys.

The toys, made up of small beads that stick together when sprayed with water, were recalled in 2007 after it was discovered that the Chinese factory making them had replaced an adhesive ingredient with one that metabolized as gamma-hydroxybutyrate, according to the opinion. GHB is...
